By accessing and using the Actimate website (https://actimate.io), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service
Actimate is a Software as a Service (SaaS) application that employs artificial intelligence to assist users in achieving their goals more effectively.

3. Subscription and Access
Upon purchasing a subscription, users are granted immediate access to the Actimate application. Continued access is contingent upon maintaining an active subscription.

4. User Data Collection

5. Non-Personal Data Collection

9. SMS Messaging
Actimate offers an SMS messaging program where users can opt-in to receive conversational messages, updates, and notifications. Here is what you need to know about our SMS service:

a. Description of Service
Users who opt into our SMS service can expect to receive messages related to the services and offers provided by Actimate.

b. Opting Out
You can cancel the SMS service at any time. Just text "STOP" to the short code or 10 digit long code (10DLC). After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

c. Assistance
If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@actimate.io.

d. Carrier Liability
Carriers are not liable for delayed or undelivered messages.

e. Message and Data Rates
Message and data rates may apply for any messages sent to you from us and to us from you. The frequency of messages varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

10. Disclaimer
Actimate provides its services on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

To the fullest extent permitted by law, Actimate shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to, use of, or inability to access or use the services; (b) any conduct or content of any third party on the services; (c) any content obtained from the services; and (d) unauthorized access, use, or alteration of your transmissions or content.
